WWICS Resorts: Punjab and Haryana HC restores liquor licence after 12 years

AFTER A period of around 12 years, a vacation bench of the Punjab and Haryana High Court on Thursday restored the L-12-C liquor licence to WWICS Resorts Private Limited which owns Forest Hill Golf and Country Club Resort at Karoran village in Mohali district.

The High Court had taken suo motu notice of the case on the basis of media reports in January 2004 about the Union Ministry of Environment and Forests finding the resort, spread over 378 acres and owned by Lt Col (retd) B S Sandhu, being developed in violation of the environmental laws. Later, the case was handed over to the CBI. The CBI probe has not been completed.

The petitioner resort had approached the High Court and submitted that since the Supreme Court had in May 2014 and the Punjab and Haryana High Court on July 4, 2014, had ruled that the resort was not established over forest land, its liquor licence should be restored as numerous players are expected to participate in the game of golf organised in the resort.

The counsel appearing for the resort had submitted that the petitioner company has set up resort only within the non-forest area which has again been identified and demarcated by various departments. The CBI investigation which commenced in 2004 also did not get over even after a lapse of 12 years.

The division bench comprising Justices M Jeyapaul and A B Chaudhari ordered that the legitimate right of the petitioner to have the licence restored provisionally cannot be declined, and directed the authorities to restore the licence within two working days.

Changes to Take Place in Canada’s Temporary Foreign Workers Cap

At present, there is a restriction on the number of foreign workers Canadian companies can hire. This thing is set to change very soon. The federal government is in plans to relax this restriction or lift it completely.
According to current rules a business entity or organization in Canada is allowed to employ only 10% foreigners of the total workforce. What this means is that only 10% of the total workforce in a company can be temporary foreign workers according to the present rules.

However, it has come to notice that there are many companies in Alberta, particularly the meat processing ones, which are feeling tremendous amount of labor shortage. This is mainly due to the reason that a cap has been in place for these companies on the number of temporary foreign workers that they can employ.

Employment minister of Canada MaryAnn Mihychuk is of the belief that when the 10% rule will be changed it will have a tremendous effect on business houses whose progress and growth is being hampered due to shortage of labor.

Other industries that have been affected due to shortage of labor include the hospitality and seafood processing industry. The companies that are particularly affected are located at far flung and remote areas.
The government is reviewing the program at present and as has been stated by Mihychuk, there may be a change in the 10% cap that has been placed by the government that has been placed for temporary foreign workers.

It is almost certain that the change will take place and that too for good. If and when this happens it will be welcome news for numerous aspirants who are waiting to relocate to Canada.

Health Care In Canada To Consume 50% Spending

Many Canadians express their disappointment that the government is not doing enough to look after the healthcare sector of the country. On the other hand, the Fraser Institute has come out with a warning that the spending on healthcare will take up nearly half of the provincial budget by the end of the year 2030.

It has been projected by the conservative think tank that the spending on health care in Canada by the provincial government will increase considerably in the next two decades. It has been claimed that these measures will result in larger deficit and increase the taxes. It is also claimed that the spending on various other projects will reduce considerably.

All these claims have been made after a study was conducted by a research institute, The Sustainability of Health Care in Canada. The study clearly indicates that because of spending on health care in Canada a large portion of spending under the provincial government program will be consumed by it.

From just over 40% in 2015, the spending is projected to go up to 47% by 2030. Bacchus Barua, a senior economist at the Fraser Institute and study coordinator stated that, “When we take a look at the historical trends, a population that is aging and the expectations that we have on inflation in the coming years, the spending the health care in Canada will not sustain for long”.

In the year 2015, the province that had the highest ratio of health care spending was Nova Scotia which was marked at 44.6%, next in line was Ontario with 42.9% spending on healthcare and the third spot was taken by British Columbia with 42.7% spending.

The study has made the prediction that the health care spending of five provinces in Canada will go above 50% of their annual budget. The rate at which spending in healthcare is expected to increase is clearly not sustainable.

Canada’s Growth Rate 2.4% From January to March

The economy of Canada grew at the rate of 2.4% in the first quarter of this year which is slightly slower than what was expected by the economists. According to reports sent out by Thomas Reuters, it has been forecasted by economists that the rate of growth will go up to 2.9%.

It has been reported by Statistics Canada that the economy expanded at the rate of 0.6% in actual terms in the first three months of this year. It has come to notice that as the quarter came to an end, the economy actually shrink at the rate of 0.2% in the month of March. This was followed by 0.1% contraction that was there in the month of February.

In the month of January, the economy had grown at the rate of 0.5%. Avery Shenfeld was speaking at CIBC World markets and mentioned that “A quarter that was going just fine ended with a slight hiccup. The economy of Canada received all the momentum in the first month only. It is an indication of the slowdown that we might expect in the coming time.”

Exports have played an important role in the GDP growth of the country, something which has increased by 1.7%. This is followed by a 0.4% decrease in the exports in the previous quarter, as has been reported by Statistics Canada. These figures are important to judge the employment generation in the country and will ultimately affect the immigration visa services.

The slowdown has been seen in business investment sector as well and there was a decrease of around 3.7% in the non-residential structures. This means that the downward trend has continued in the past five quarters. An important factor in the decline is because of the slowdown in investment in the gas and oil sector. Migrant Workers Should Be Granted Permanent Residence Says Canada’s Union

Indications are being provided from the latest actions that are taken by United Food and Commercial Workers (UFCW) union. UFCW Canada has called for Temporary Foreign Workers Program (TFWP) to be taken away and an immigration system should be put in place.

This is one of the recommendations that are made to the parliamentary committee by UFCW Canada. The temporary foreign workers program will be reviewed by parliamentary committee very soon at a hearing in Ottawa. Canada’s Union Calls For Permanent Immigration Option for Migrant Workers

United Food and Commercial Workers Union (UFCW), a leading union in Canada for migrants and temporary foreign workers, says the Temporary Foreign Workers Program (TFWP) from the federal government should be changed into a system that allows migrant workers to apply for permanent residence Canada.

These workers will have legal access to speak and fight for their rights and they will be able to work freely without any fear.

Local Unions of UFCW Canada represents thousands of temporary foreign workers. These people do not have permanent residence of Canada under the Provincial Nominee Program. There is a collective agreement between major employers and UFCW Canada to provide proactive support to foreign workers who arrive in the country.

One of the members of UFCW Canada came to this country from El Salvador back in 2005. The member expressed that without the support of the employee working together and of the union the experience would have been quite different. Canada Rejects Immigration Application for Chinese Workers

The Canadian government has decided to take away Canada permanentresidency status of three immigrants from China who is employees of Huawei. The reason given for this action is that there is suspicion for terrorism, spying and government subversion.

A fourth person, who is an ex-employee of Huawei whose, spouse is currently working for the company, was informed that his application for Canada immigration will also be rejected.

Huawei is a smart phone maker and is the third largest company in the world in this industry. The company started its Canada operation in the year 2008. The company has come under scanner from the Canadian government citing concerns for unsubstantiated spying.

An immigration officer at Chinese embassy in Hong Kong disclosed that a Chinese applicant for Canada permanent residency will be rejected. In the decision for rejection the name of the spouse of the applicant is also included. Both the people are working for the company at present.

The rejection letter stated that there is sufficient evidence that has made the authorities to come to the conclusion that Canada permanent residency should not be granted to these people. Terrorism, espionage and government subversion are the reasons given for rejecting Canada immigration application.

Another letter was issued by Canada immigration official in which the spouse of the applicant was denied entry into the country. The names of all the four applicants were presented to The Globe and Mail but asked to maintain them confidential. The case for both the couples was presented by a Hong Kong based Canada immigration consultant.

Huawei, at present has operation in 170 countries, only recently the company started having some problems in it US operation. The House Intelligence Committee of the USA has alleged that risk of foreign espionage is posed by the company. However, nothing substantial was put forward to support the claim.

Same kind of problem was reported by the Australian authorities in the year 2012. The company was blocked from bidding on the national broadband of the country. Some of the Canada immigration official refused to put forward any more details on the incident.
